Terms and Conditions
By signing up for a lesson or course at Lab Six, you agree to adhere to the following terms and conditions as detailed below upon enrolment as a student with Lab Six Australia Pty Ltd. The following terms and conditions are non-negotiable and are exercised at the discretion of Lab Six Australia Pty Ltd.
Terms and Conditions of Trading
1. Payment Terms
1.1 Payment for all courses are to be made in Australian Dollars by cash, credit card, bank transfer or cheque made payable to Lab Six Australia Pty Ltd.
1.2 Upon receipt of payment for course fees, the student’s place will be secured in the course subject to the following payment terms outlined below.
1.2.1 Course fees may be paid upfront, in full prior to the courses commencement, at the students first lesson of their course, or on a scheduled Payment Plan as agreed upon between the student and Lab Six Australia Pty Ltd.
1.3 Course fees are not transferrable between Lab Six students or Lab Six Courses.
2. Default
2.1 If a student fails to make a Scheduled Payment as part of a Payment Plan, Lab Six Australia Pty Ltd reserves the right to suspend the use of facilities and tuition pending full payment of the outstanding tuition fees.
2.2 If a student fails to pay a Scheduled Payment within 7 days of the due date in accordance with the above Schedule, the students will be liable to pay interest of 10%, compounded daily on the outstanding amount.
2.3 If a Scheduled Payment is not made within 14 days of the due date in accordance with the above Schedule, the student will be liable for a $100AUD administration fee in addition to interest of 15%, compounded daily on the outstanding amount.
3. Refund Policy & Cooling Off Period
3.1 All fees paid in advance prior to course commencement may be refunded if Lab Six Australia Pty Ltd is notified of course withdrawal within 7 days of Enrolment Agreement.
3.2 Lab Six has a strict 7-day cooling off period from the date of Enrolment Agreement. This 7-day period beings on the day of Enrolment Agreement (“Cooling Off Period”)
3.3 Course fees will not be refundable after the commencement of a course or after Cooling Off Period has expired under any circumstances, including and not limited to the following:
Student failure, deferral, cancellation and/or withdrawal from the course.
4. Cancellation
4.1 Students agree upon enrolment to pay the total course amount as stipulated in the Enrolment Agreement Form.
4.2 Should a student cancel their place in a course after the Cooling Off Period has expired the student is liable for all course fees which have been invoiced and this amount is immediately payable by the student to Lab Six Australia Pty Ltd.
4.3 If this amount is not paid at the time of course cancellation, the amount will be recovered by external debt recovery services.
5. Recovery
5.1 If a student fails to make a Scheduled Payment by the due date listed on the invoice for that payment, Lab Six Australia Pty Ltd will first endeavour to recover the payment internally.
5.2 If payment is not made after internal recovery attempts, Lab Six will engage external debt recovery services to recover the amount owing including any accrued interest from the student directly.
5.3 All expenses, costs or disbursements incurred in recovering any outstanding monies including debt collection fees, solicitor fees and all legal costs will be paid by the student.
6. Damage
6.1 Students will be liable to pay the full cost of repair or replacement of any equipment they damage including but not limited to turntables, CD players, audio mixers, speakers, furniture, LCD/LED screens, computers, laptops, cabling, walls, display items, stands, tables and any other items on the premises.
6.2 The cost of repair or replacement of damaged equipment will be determined by Lab Six Australia Pty Ltd at its sole discretion.
7. Missed Classes
7.1 If a student misses a scheduled tuition session they will forfeit that session and no make-up session will be offered. The course work for that missed session will be made available to the student by Lab Six Australia Pty Ltd.
7.2 A make-up session may be scheduled if notice of more than 24 hours is given via email or telephone. If notice if given, but not within 24 hours then clause 8.1 above applies.
7.3 Lab Six Australia Pty Ltd reserves the right to grant make up sessions on a case by case basis.
8. Rights
8.1 The student acknowledges that Lab Six is entitled to presume that any person purporting to have the authority to bind the student to a contract for the supply of services from Lab Six has the authority they claim.
8.2 If a student’s conduct is deemed unsuitable, Lab Six reserves the right to expel the student. All outstanding course fees are due at the time of expulsion.
8.3 Lab Six reserves the right to cancel or reschedule a course or lesson.
8.4 Lab Six reserves the right to reproduce any image or video of a student taken during their enrolment at Lab Six for promotional purposes, in any form and by any medium.
9. Intellectual Property
9.1 All material provided to students, including but not limited to teaching materials, coursework, electronic recordings, project files, samples and digital content, remains the intellectual property of Lab Six and is not to be distributed or reproduced by students.
10. Fitness For Attendance
10.1 All students enrolled or booked into attendance at Lab Six cannot be under the influence of, in possession of, or found to be cultivating, selling or supplying drugs and / or alcohol, or being in any other way impaired for attendance and study on property or premises owned or controlled by Lab Six.
10.2 Alcohol
The accepted level of alcohol will be at the current level denoted in the Road Traffic Act 1974.
10.3 Drugs – Illicit and other illegal substances
Students must ensure they are not under the influence of, suffering adverse effects of, in possession of, or found to be cultivating, selling or supplying drugs or other illegal substances whilst undertaking study on property or premises owned or controlled by Lab Six.
10.4 Prescription and other Medication
It is the Student’s responsibility to make Lab Six aware of any medication that the student may be taking which may have a detrimental impact on their ability to carry out their studies on property or premises owned or controlled by Lab Six.
11. Disclosure of Learning Difficulties, Disabilities, Medical and/or Mental Health Conditions
There is no legal obligation for a person with a disability to disclose information about their disability unless it is likely to have an effect on:
their ability to meet the inherent requirements of the course of study
their ability to work safely
the safety of co-workers and Lab Six Staff
However, in order for a person with a disability to request reasonable adjustments they will need to disclose their disability. Disclosure of disability may occur during the application process, during the interview process, during the induction period or anytime throughout employment. Adjustments, including flexibility, may be required at any time. Reasonable adjustments may include the delivery of course content, modified curriculum or flexible studying arrangements.
12. Entire Agreement
12.1 These Terms and Conditions of Trading are additional to any other terms communicated in respect of the sale and supply of services, and where they are in conflict, these Terms and Conditions of Trading shall prevail.
